An estate plan is a legal strategy or a set of legal documents that outlines how a person's assets and affairs will be managed and distributed after their death or in the event of their incapacity.
It involves the creation of various legal instruments and arrangements to ensure that an individual's wishes regarding their estate, including property, finances, and healthcare decisions, are carried out.
While each client has unique needs, we always begin with a Peace of Mind Planning Session and provide a questionnaire to assess your Estate Planning needs and goals.
During the consultation, we’re able to take a deep dive into the issues and decisions that need to be addressed in order to create an individualized Estate Plan that best suits the client’s needs.
From there, our fees will vary based on the individual and the unique facts of the Estate Plan.
Once we’ve determined your needs and the individualized plan has been created, we begin implementing the Estate Planning process.
We continually are in communication with the client, from document signing, goal assessment, and reviewing all Estate Planning options.
We believe in continually serving our clients and building a trusting relationship via ongoing phone calls, emails, and meetings in order to create and sustain the most effective Estate Plan.
After the Estate Plan has been created and all the necessary documents have been signed, our work continues with our clients and any of their professional advisors to secure alignment and funding.
We are always available for any questions our clients may have, in addition to phone calls, emails, and our blog posts.
Here are some estate planning basics to consider:
Wills – Decide where you want your property to go after you die, whether to family, friends, charities, educational institutions or elsewhere. Appoint a guardian for your minor children, and designate whom you would like to serve as the personal representative of your estate.
Advance Directives – Make important decisions about how you would like your financial and legal affairs handled if you become incapacitated, and what kinds of medical procedures you would or would not want. Choose people you know and trust to make decisions on your behalf regarding your health care and finances. We’ll draft the appropriate powers of attorney, health care surrogate designations, living wills and DNROs that reflect your wishes.
Trusts – Distribute your property outside of probate, saving time and money to the beneficiaries of your estate. Also, keep your estate plan out-of-court and confidential.
Business Succession – Leaving a family business to future generations is more than leaving an inheritance; it’s leaving a way of life. Unfortunately, without proper planning, a business can be lost to taxes, lack of liquidity and other risks that arise during transfer. Clark Law PLLC can help make sure your business ownership is transferred effectively and advantageously to you and the future owners, so your business can grow and thrive as long as you and your successors wish it to.
